Should I File a Personal Injury or Workers' Compensation Claim?
If you were injured at work, you generally have one of two options available when it comes to pursuing compensation: file a workers' comp claim or file a personal injury lawsuit against a third party.
Option 1: File a Workers' Compensation Claim
Workers' compensation benefits provide workers with compensation for lost wages and medical bills when they are injured on the job. Under state law, employers are required to have workers' compensation insurance to cover these types of claims.
Requirements of a Workers' Compensation Claim
In order to file a successful workers' comp claim, employees must:
- Show that they were injured on the job while performing work duties
- Show that they have suffered a traumatic accident, such as the loss of a limb, or an occupational injury, such as damage caused by repetitive motion
- Notify their employer within 30 days
- Undergo medical care as soon as possible to document the extent of damage
What Do Workers' Compensation Benefits Cover?
In Indiana, injured workers can expect to receive the following benefits:
- Two-thirds of their average weekly wage; this income is provided for the amount of time recommended by the employer-approved physician
- Coverage for medical care by the employer-approved physician
- Reimbursement for approved expenses such as medication
