Indiana Workers Compensation Laws vs. Nation – Choice of Physician

Workers' Compensation

As discussed before, Indiana is a future medical state for injured workers. That means no deductibles and no co-pays. 100% of the past, present, and future medical expenses are covered. Most jurisdictions, including Indiana, pay for reasonable and necessary medical treatment to cure or relieve the effects of the injury. But there are some differences and exceptions throughout the country.

Choice of Physician

Indiana workers do not get to choose their physician. An estimated eight (8) states, including Indiana, have strict guidelines that give the employer the exclusive right to choose the injured worker’s physician or medical provider.* This is a frequent complaint from injured workers, who do not trust the “employer’s doctor” often with good reason.

Nearly twice as many states allow the injured worker to choose his/her own physician. The remaining states have various exceptions to the rules that gives the worker some input in choosing physician.
